1. COMPANY BACKGROUND

    GASGEN TECHNOLOGIES (Pty) Ltd is a South African company selling, distributing, importing and exporting dual fuel carburettors, generator conversion kits, and other energy-related items under the following brand: GASGEN TECHNOLOGIES. In terms of Section 51(1) of the Act, all heads of private bodies are required to compile a manual that provides information regarding the subjects and categories of records held by such private bodies. This manual is intended to fulfill this requirement. The company supports the supply and availability of information as contemplated in the Act.
    The Secretary of the Company is duly authorized to ensure that the requirements of the Act are administered in a fair, objective and unbiased manner. Accordingly, all requests for access to records should be addressed to:

    2. THE SAHRC

      The Act grants a requester access to records of a private body if the record is required for the exercise or protection of any rights. If a public body lodges a request, the public body must be acting in the public interest.
      Requests in terms of the Act shall be made in accordance with the prescribed procedures and at the rates provided. The forms and tariffs are dealt with in paragraphs 6 and 7 of the Act.
      Requesters are referred to the Guide in terms of Section 10 of the Act. The Guide has been compiled by the SAHRC, which contains information for the purposes of exercising Constitutional Rights. The Guide is available from the SAHRC at the following contact details:

      3. APPLICABLE LEGISLATION

        The Company is legally required to ensure that certain categories of records are available for access, without a formal request:

        • The Occupational Health and Safety Act No. 85 of 1993;
        • The Constitution of the Republic of South Africa No.3 of 1994;
        • Promotion of Access to Information Act No. 2 of 2002;
        • The Value-Added Tax Act No. 89 of 1991;
        • Income Tax Act No. 58 of 1962;
        • Companies Act No. 71 of 2008;
        • Basic Conditions of Employment Act No. 75 of 1997;
        • Employment Equity Act No. 55 of 1998;
        • Labour Relations Act No. 66 of 1995;
        • South African Revenue Services Act, 34 of 1997.

          5. FORM OF REQUEST

            To facilitate the processing of your request, kindly:

            • Use the prescribed form and pay to the prescribed fees, details available on the SAHRC website and the Gasgen Technologies Website.
            • Address your request to the Information Officer;
            • Provide sufficient details to enable the Company to identify the requester and record(s) requested, the form of access required specify the postal address or fax number of the requester in the Republic of South Africa; and the right which the requester is seeking to exercise or protect and provide reasons for the request.
            6. OTHER INFORMATION

              The company's Information Officer will respond to any request within 30 days of receiving the request by indicating whether such request for access has been granted or not. Please note that information and /or documents shall only be made available in accordance with the provisions of the Act. Requests for access to these records may be refused in terms of Sections 62 to 69 of the Act. Such as:

              • Protecting personal information that the company holds about a third person (who is a natural or juristic person) from unreasonable disclosure;
              • Protecting commercial information that the company holds about a third party (e.g. trade secrets, financial, commercial, scientific or technical information that may harm the commercial or financial interests of a third party);
              • If disclosure would result in a breach of a duty of confidence owed to a third party;
              • The record is privileged from production in legal proceedings unless the privilege has been waived;
              • Disclosure of the record will put the Company at a disadvantage in contractual or other negotiations or prejudice it in commercial competition;
              • Disclosure of the record (containing trade secrets, financial, commercial, scientific, or technical information) would harm the commercial or financial interests of the Company;
              • Records containing information about research being carried out or about to be carried out on behalf of a third party or the Company.

              If you request access to a record that contains information about a third party, we are obliged to attempt to contact this third party to inform them of the request and to give them an opportunity to respond by either consenting to the access or by providing reasons why the access should be denied. In the event that the third party furnishes reasons for the support or denial of access, our designated Information Officer will consider these reasons in determining whether access should be granted. You may appeal against a refusal of access by our Information Officer. Please refer to Part 4 of the Promotion of Access to Information Act for further details on the Appeal Process.
